Summary

Understanding the laws and regulations that govern data privacy across your organization is critical for any company, but it can be challenging. As a result, too many security and risk (S&R) professionals pay little attention, hoping that a single generic solution will meet most of the requirements and keep them from getting into too much trouble should an incident occur. While such a stance is tolerable in the European Union (EU) because all the variant national privacy laws share a common foundation — the Data Protection Directive — it does not stretch globally. Across Asia, data privacy laws are fragmented, and the regulatory environment is different for each jurisdiction. Driven by technological advances and a flourishing Internet population, cybercriminals and other threats to privacy have led to the creation and revision of laws that surpass the EU in complexity. Significant penalties mean that compliance is not optional and specific focus is required to remain within the legal boundaries. This study highlights key data privacy regulations from across the Asia Pacific region and presents best practices for staying on top of these evolving requirements.
